RULES - lots of RULES, but well worth reading
You will be asked to sign a buyer agency agreement before any properties are shown or negotiated. Here are the special stipulations for the buyer agency agreement that permit me to represent you, the buyer, and to define the terms under which you will be rebated some part of my commission. These stipulations are important for my protection and for yours. If you are not already pre-qualified, I will assist you in that process.
In order to share the selling agent’s commission (hereafter known as % incentive):
1. Do your share of the work to find the home within the guidelines of the Incentive Program. Gena will email listings that match your profile on a regular basis.
2. Allow Gena Beach to set up showings for you on resales and register you at new home subdivisions to ensure that she is able to collect a commission and thus give you a rebate.
3. Any listed home shown to you by Gena Beach will entitle Gena to collect the commission paid by the seller up to 120 days from the showing of the home.
4. Gena will not write a contract without seeing the home first.
5. Your incentive will be used to offset your closing costs or other such approved costs to close, per the mortgage company guidelines. In any case, this incentive must be disclosed to all parties prior to closing.
6. By signing this agreement you will be under an Exclusive Buyer Agreement with Drake Realty which means that Drake is your exclusive real estate broker. State law prohibits Broker from representing Buyer as a client without first entering into a written agreement with Buyer under O.C.G.A. 10-6A-1 et. seq.
My duties to you, my client, will include:
1. Confidentiality between you and me
2. Expert guidance and advice about the resale potential of the homes I see with you throughout contract negotiation
3. Inspection negotiation
4. Closing set-up, advice and review of settlement statement, attend closing with you
5. Compliance with all applicable laws in performing duties hereunder including the Brokerage Relationships in Real Estate Transactions Act, O.C.G.A. 10-6A-1 et. seq.
Your duties to me, your exclusive broker will include:
1. Advise others that you are being represented by Gena Beach, as your buyer agent
2. Searching and exterior preview of homes that interest you
3. Reasonable intent to purchase a property with good will
*a. A fee of .0012 of the sales price is deducted from the incentive given to the buyer if the property is listed in FMLS. This is used to pay the FMLS listing fee. b. There is also a $250.00 transaction fee that I am required to pay my broker. Both of the fees may be waived depending on the amount of the incentive.
